Theft
Under Georgia law, a theft crime can involve several situations. These crimes include: theft by taking, theft by deception, theft by conversion, theft of services, theft by shoplifting, and theft by receiving stolen property are all individual laws under GA Code § 16-8-1. Any of these crimes involve a fine and imprisonment depending on the value of items involved.
Robbery
Under GA law, § 16-8-40, “a person commits the offense of robbery when, with intent to commit theft, he takes property of another from the person or the immediate presence of another” by use of force, intimidation or by sudden snatching. If a weapon is involved, this is considered armed robbery and can be punished by death or life in prison. Even a lessor robbery conviction can result in a 20 year sentence.
Burglary
Burglary crimes involve entering a “dwelling house of another or any building, vehicle, railroad car, watercraft, aircraft, or other such structure designed for use as the dwelling of another” with intent to commit a felony or theft. A burglary involving breaking into a retail establishment is often referred to as a “smash and grab” burglary. A conviction for even a first time offense, can result in a prison sentence between 1 and 20 years.
